La literatura sobre razonamiento probatorio busca incidir en la determinación de los hechos en los procesos judiciales. Para alcanzar dicho propósito, no basta con dirigir la mirada hacia disciplinas extrajurídicas exitosas e integrar lo que de ellas pueda extraerse a las teorías jurídicas de la prueba y a la práctica judicial. Es necesario, además, considerar el tipo de hechos a probar, los roles de las reglas jurídicas aplicables, y asumir que litigantes y jueces, actuando en un contexto institucional, podrán ser (...) más o menos agudos en la discusión fáctica, entre otras cosas. Minimizar la influencia de tales factores expone a los estudios probatorios a tener un bajo rendimiento práctico. Algo de esto ha ocurrido con la llamada concepción racionalista de la prueba. Su innegable aporte al debate académico en español no ha ido a la par de su impacto judicial. Para explicar esta brecha entre teoría y práctica, identificamos tres creencias-obstáculo que afectan a su discurso sobre la prueba y que deben ser sorteadas si lo que se busca es influir en la forma en que se juzgan los hechos en un sistema judicial realmente existente. This study aimed to adapt the Flourishing Scale to a Chilean high school context and provide evidence of its validity. Data were collected from 1,348 students from three different Chilean schools. The results of confirmatory factor analysis supported a one–factor solution, multiple–group CFA supported gender invariance, and structural equation model indicated that the FS is related to positive and negative academic feelings. Overall, the evidence indicates that the Flourishing Scale adapted to the high school context is an instrument that produces (...) valid and reliable scores in our high school Chilean sample. This brief report assessed the psychometric validity and gender invariance of the School Burnout Inventory –a measure of students’ exhaustion, cynicism, and inadequacy– in a convenience sample of 972 high school Chilean students ranging between 12 and 18 years old. The results showed that: the SBI produces adequate scores in terms of reliability; two models fitted adequately fit to our sample and was invariant across gender; and the SBI scores were significantly related to other related constructs. There are several approaches to the way in which standards of proof in law should be understood. In the central article in this issue, Rodrigo Coloma suggests that they should be conceived either as thresholds either as prototypes. He also offers a taxonomy of the different uses of standards of proof, which transcends their function as error distributors. In their comments on the paper, Raymundo Gama and Claudio Agüero clarify and challenge this way of understanding standards of proof. Some (...) of their criticisms are right on target, but many others are directed more at Coloma’s theoretical presuppositions than at his substantial contributions. Even though the link between perceived corporate social responsibility fit and corporate reputation has received much attention from scholars, this tradition has ignored that the underpinnings of this association vary depending on the particular characteristics of each industry under study. To delve into this matter, we investigate in the increasingly relevant context of controversial industries how PCSR-fit could enhance corporate reputation and which are the mediating mechanisms of this association. Our academic contribution is twofold. First, we find that controversial sectors (...) indeed can increase corporate reputation through CSR activities. However, we find that to achieve this goal, the nature of PCSR-fit should be different than what extant literature indicates, because companies in these settings should directly focus on avoiding or reducing their inherent controversial harm or impact. Second, we evidence that “CSR initiatives' legitimacy” and “situational skepticism” mediate the PCSR-fit and corporate reputation relationship in CIs. Therefore, we further unravel the underpinnings of this association to advance what we know on the matter and aid practitioners in this particular context. (shrink)

Despite the centrality of the topic for the debate on sustainability, future generations have largely been ignored by business ethics. This neglect is in part due to the enormous philosophical challenges posed by the concepts of future generations and intergenerational duties. This article reviews some of these difficulties and defends that much clarity would be gained from making a distinction between future generations and the next generations. It also argues that the concept of next generations offers a better starting point (...) for business ethics to incorporate the topic in its research agenda. We then suggest four potential pathways to explore this territory. The four approaches build on the notion of organizations as communities with memory and vision, on the narrative shape of organizational life, on the affinity of stakeholders with the next generation, and on systems of indirect reciprocity. These first two approaches are connected to communitarian approaches to business ethics, and the last two engage in a dialog with contractarian views and stakeholder theory. This paper explores the antecedents of intra-organizational social capital from a comprehensive perspective that integrates leadership as the main antecedent. To be precise, we propose that intra-organizational social capital is a direct consequence of an organizational ethical and community context to which leadership in the servant dimension plays a transcendental role. Indeed, since the seminal work of Greenleaf the servant leadership concept has been widespread among business academics and professionals for the value it brings to the organization not only in (...) ethical but also in excellence terms. Among the recent styles and theories on leadership up to date, servant leadership fits perfectly an organizational ethical context both at the organizational or group level, acting in addition as a main promoter of that context. Furthermore, servant leadership is linked to the cultivation of helpful, altruistic and servant attitudes among the employees which are useful elements in the generation of social capital inside the organization. A model then for understanding the causes of intra-organizational social capital with a focus on servant leadership is here elaborated from which conclusions and implications for Management will be delineated. Situados en un progresivo traspaso de responsabilidades en la ejecución de los servicios sociales desde el Estado hacia actores no gubernamentales, aparece una demanda hacia el mismo Estado, el cual en lugar de simplemente declinar su labor, debiera de hecho expandir su regulación de modo de asegurar que la oferta social sea eficiente en satisfacer al ciudadano usuario en aquellos servicios prometidos por las políticas y programas sociales. Así mismo, la institucionalidad pública debiera reconocer las demandas del mundo privado para (...) actuar articuladamente hacia fines comunes, que finalmente conduzcan a un horizonte de desarrollo de una sociedad más igualitaria. O artigo analisa a contribuição original da obra “A Condição Humana” para a redefinição do significado político da liberdade em suas determinações democráticas fundamentais e para a crítica da desmundanização como a base comum sobre a qual se fundam as nossas mais recentes experiências políticas: a destruição inédita do mundo comum no totalitarismo e a hegemônica despolitização liberal das atuais democracias formais de massa e mercado que atrofiam a esfera política da ação e do discurso.

Neste trabalho, pretendemos avaliar criticamente algumas das teses de John McDowellsobre a natureza da virtude, tal como expostas em seu artigo “Virtue and Reason” e, ao fazê-lo,expor algumas de suas limitações. Mais especificamente, tratarei o que vejo como problemas emsua apresentação da virtude como uma forma de conhecimento, e sua proposta – corporificada natese da unidade das virtudes – de que as virtudes comumente reconhecidas deveriam ser vistascomo manifestações parciais da virtude enquanto tal. Também enfocarei a assertiva de McDowellde que (...) o conhecimento que constitui a virtude não pode ser visto como tendo um conteúdoproposicional que se preste a uma codificação em princípios de conduta – a tese de nãocodificabilidade– e a relação da postura pessoal de McDowell com a empreitada mais ampla daética de virtudes. In this paper I argue that the search for explainable models and interpretable decisions in AI must be reformulated in terms of the broader project of offering a pragmatic and naturalistic account of understanding in AI. Intuitively, the purpose of providing an explanation of a model or a decision is to make it understandable to its stakeholders. But without a previous grasp of what it means to say that an agent understands a model or a decision, the explanatory strategies will (...) lack a well-defined goal. Aside from providing a clearer objective for XAI, focusing on understanding also allows us to relax the factivity condition on explanation, which is impossible to fulfill in many machine learning models, and to focus instead on the pragmatic conditions that determine the best fit between a model and the methods and devices deployed to understand it. After an examination of the different types of understanding discussed in the philosophical and psychological literature, I conclude that interpretative or approximation models not only provide the best way to achieve the objectual understanding of a machine learning model, but are also a necessary condition to achieve post hoc interpretability. This conclusion is partly based on the shortcomings of the purely functionalist approach to post hoc interpretability that seems to be predominant in most recent literature. (shrink)

In this paper I defend the idea that there is a sense in which it is meaningful and useful to talk about objective understanding, and that to characterize that notion it is necessary to formulate an account of explanation that makes reference to the beliefs and epistemic goals of the participants in a cognitive enterprise. Using the framework for belief revision developed by Isaac Levi, I analyze the conditions that information must fulfill to be both potentially explanatory and epistemically valuable (...) to an inquiring agent and to a scientific community. To be potentially explanatory, the information must state the relations of probabilistic relevance that the explanans bares to the explanandum. But a potential explanation con only be a bona fide explanation if it becomes part of inquiry, that is, if an agent or a group of agents can see any value in it for their cognitive purposes. I provide a way to evaluate the epistemic value of a potential explanation as a function of its credibility and its informational content. (shrink)

En este trabajo se realiza una propuesta de comunicación transdisciplinar entre las ciencias cognitivas y la educación, tal y como se perfilan en el siglo XXI. En un primer lugar se contextualizan estos procesos de comunicación en el continuum histórico que transita desde los inicios del siglo pasado, con la configuración de la psicología educativa dentro del constructo de las ciencias educativas; pasando por la constitución de las ciencias cognitivas, a mediados del siglo XX que propició la emergencia de la (...) síntesis disciplinar entre las ciencias del cerebro y de la mente, para posibilitar un encuadre arraigado en el presente, y en las propuestas de consiliencia entre neurociencia cognitiva y educación. Desde este presente histórico, se efectúa una propuesta de diálogo entre las distintas epistemes (educativas y cognitivas), en relación con el fenómeno de la educación bilingüe, y en concreto en el contexto intercultural ecuatoriano. La integración de los distintos niveles de análisis que configuran un fenómeno complejo, como lo es todo fenómeno educativo, refleja cómo los intentos transdisciplinares orientados a reconocer la complejidad ontológica de un mismo objeto de estudio, requiere del diálogo entre las distintas epistemologías y metodologías implicadas. La apertura del campo educativo a las dimensiones mentales y cerebrales en su expresión cognitiva, requiere en este s. XXI procesos de apertura recíproca respecto de la influencia que el eje cultura-educación ejerce en el modelamiento de los procesos de cognición y aprendizaje. (shrink)

Los sesgos cognitivos afectan negativamente la toma de decisiones en todas las esferas de la vida, incluyendo las decisiones de los jueces. La imposibilidad de eliminarlos por completo de la práctica del derecho, o incluso de controlar sus efectos, contrasta con el anhelo de que las decisiones judiciales sean el resultado exclusivo de un razonamiento lógico-jurídico correcto. Frente el efecto sistemático, recalcitrante y porfiado de los sesgos cognitivos, una posible estrategia para disminuir su efecto es enfocarse, no en modificar el (...) comportamiento de los agentes judiciales, sino en moldear su entorno para que los sesgos tengan menos oportunidades de aparecer. En particular, es más provechoso concentrar los esfuerzos en identificar aquellas reglas procesales que faciliten o limiten el efecto de los sesgos. En este ensayo propongo un diálogo fructífero entre el derecho y la psicología que puede llevar a mejorar la calidad de los sistemas judiciales. La propuesta está basada en la creación de guías de práctica judicial que puedan servir de base para la creación de protocolos procesales que limiten en la medida de lo razonable sus efectos negativos y conduzcan a mejores decisiones judiciales. Wild animals probably have net negative lives. Christine Korsgaard rejects the view that we might engineer paradise by redesigning nature and animals so that they have the best possible existences. She believes the genetic changes required would not be identity-preserving, thereby causing animals to cease to exist. I argue, first, that paradise engineering is permissible. Many harms are caused by non-sentient natural entities and processes. Moreover, sentient animals can survive modifications compatible with their psychological persistence over time. A common objection to probabilistic theories of causation is that there are prima facie causes that lower the probability of their effects. Among the many replies to this objection, little attention has been given to Mellor's (1995) indirect strategy to deny that probability-lowering factors are bona fide causes. According to Mellor, such factors do not satisfy the evidential, explanatory, and instrumental connotations of causation. The paper argues that the evidential connotation only entails an epistemically relativized form of causal attribution, not (...) causation itself, and that there are clear cases of explanation and instrumental reasoning that must appeal to negatively relevant factors. In the end, it suggests a more liberal interpretation of causation that restores its connotations. Una objeción común a las teorías probabilísticas de la causalidad es que aparentemente existen causas que disminuyen la probabilidad de sus efectos. Entre las muchas respuestas a esta objeción, se le ha dado poca atención a la estrategia indirecta de D. H. Mellor (1995) para negar que un factor que disminuya la probabilidad de un efecto sea una causa legítima. Según Mellor, tales factores no satisfacen las connotaciones evidenciales, explicativas e instrumentales de la causalidad. El artículo argumenta que la connotación evidencial sólo implica una forma epistémicamente relativizada de atribución causal y no la causalidad misma, y que hay casos claros de explicación y razonamiento instrumental que deben apelar a factores negativamente relevantes. Se sugiere una interpretación más liberal de la causalidad que reinstaura sus connotaciones. (shrink)

Most nonhuman animals live on the terms imposed on them by human beings. This condition of being under the mastery of another, or domination, is what republicanism identifies as political unfreedom. Yet there are several problems that must be solved in order to successfully extend republicanism to animals. Here I focus on the question of whether freedom can be a benefit for individuals without a free will. En el marco de la elaboración de la Estrategia de Desarrollo Sostenible de la Región de Murcia (EDS), España el autor se plantea como punto de partida una análisis-evaluación del estado de la sostenibilidad regional, lo que supuso la construcción de un modelo de análisis y un método para ese diagnóstico de partida. Este reto supuso recorrer la corta historia de la epistemología de la sostenibilidad, postulando que ella debe ser epistemología heurística, enactiva, participativa y contingente . Das Aufkommen der "klassischen Mechanik" wird als paradigmatisch für die Entstehung des neuzeitlichen wissenschaftlichen Denkens angesehen. Geht man nun dem Beginn dieser Entwicklung nach, so stößt man sehr bald auf den Begriff der Selbsterhaltung. Das Postulat der Selbsterhaltung erweist sich als zentrale Kategorie bei der Herausbildung einer "externen" Naturvorstellung, nach der ein sich bewegender Körper keiner zusätzlichen Kraft bedarf, um die betreffende Bewegung aufrechtzuerhalten . Sie erhält sich von selbst. Das Prinzip der Selbsterhaltung taucht in dieser Epoche auch in verschiedenen (...) anderen Disziplinen auf, beispielsweise der Staatsphilosphie und der Ethik . Ein paralleles Phänomen während dieser Zeit ist eine beginnende Emanzipation des Individuums. Der allmähliche Ausbau einer Autonomie im Denken und Fühlen findet seinen Ausdruck in einem neuen Vernunftsbegriff, der nicht mehr in Abhängigkeit von theologischen Postulaten steht. Die Autonomie des Individuums wird weitgehend als Selbsterhaltung der Vernunft verstanden. Es liegt nahe einen Zusammenhang zu vermuten zwischen der neuzeitlichen Naturerfassung auf der Grundlage des Selbsterhaltungsbegriffes und der "Entdeckung" einer individuellen, sich selbst konstituierenden Vernunft. In this work, our hypothesis is that the parody towards historiography and its textualities is the principal axis in Los Perros del Paraíso, by the Argentinian Abel Posse, considered by the critics as part of the New Latin-American historical novel. This textual feature allows questioning the historiographic story and articulating other possible visions of history. This parody is manifested through three mechanisms: 1) form, through which quotations and referents coincides, as well as notes, data and other elements usually found in (...) other formats than literature, i.e., text pretending veracity and non-fiction; 2) superposition of stories overlapping and co-occurring in opposition to the line and causality of the historical text; and 3) the subjective perspective of the narrator, who constantly comments events, thus opposing the historicist objectivity. There is a growing awareness that there are many subtle forms of exclusion and partiality that affect the correct workings of a judicial system. The concept of epistemic injustice, introduced by the philosopher Miranda Fricker, is a useful conceptual tool to understand forms of judicial partiality that often go undetected. In this paper, we present Fricker’s original theory and some of the applications of the concept of epistemic injustice in legal processes. In particular, we want to show that the seed (...) planted by Fricker has flourished into a rich field of study in which the concept is used to analyze many different phenomena in law, not always following the original characterization provided by her. This has led to a distinction between what we will call the narrow version of the concept, which is closer to Fricker’s original account, and the wider version of epistemic injustice, which is a more controversial notion because it is always on the verge of morphing into other well-known concepts like sexism, racial discrimination, oppression, silencing, and gaslighting. We will show that the value of the narrow version is mostly theoretical, and that in order to use the concept of epistemic injustice one must adopt a more liberal understanding of it. (shrink)

This article attempts to read the very concept of reading as articulated and problematized by Derrida’s newly discovered Geschlecht III. I argue that Derrida enacts a reading of Heidegger in Geschlecht III in ways that help us understand the strong sense Derrida gives this word. In the article’s first part, I dwell on Derrida’s—and Heidegger’s—methodological precautions that problematize the traditional concept of reading so as to open the way for a reading of Heidegger that does not bank on the metaphysical (...) presuppositions the very same Heidegger warns us against time and again. In the second part, I turn to Derrida’s topotypological examples that show us what traditional methodology problematically presupposes when “reading” Heidegger. The article ends by turning to the Derridean notion of “overprinting”—and the uncanny effects of doubling it implies—as a way to think about what it means to read and countersign Heidegger’s text. El movimiento de ‘retorno a Kant’ del siglo XIX se constituye en sus orígenes a través del rechazo a la filosofía especulativa de Hegel. Por diversos motivos que no han sido debidamente clarificados aún, este movimiento filosófico culmina su derrotero a principios del siglo XX afirmando la necesidad de una renovación del hegelianismo. El objetivo del presente estudio es explicar los motivos y las consecuencias de la transformación progresiva del neokantismo de Baden en una variante de neohegelianismo. Esta breve introducción a la filosofía de la ciencia parte del hecho de que tanto la investigación científica como el razonamiento probatorio judicial tienen un carácter inductivo. En esa medida, comparten características esenciales que permiten que el derecho se nutra de muchas de las reflexiones de la filosofía de la ciencia. El capítulo se concentra en cuatro temas principales: los criterios de demarcación entre el conocimiento científico y la pseudociencia; el carácter derrotable de las conclusiones de la ciencia y el (...) derecho; la estructura corroborativa de la relación entre la evidencia y las hipótesis científicas y judiciales; y las teorías de la explicación tanto en el ámbito científico como en el judicial. Nuestra investigación indaga sobre las posibilidades de establecer una lectura ontológico-relacional de la obra de Giordano Bruno, a partir de “La lámpara de las treinta estatuas” (Lampas triginta statuarum). La particularidad de esta obra, escrita en Wittenberg en 1587, reside en la exposición de la producción ontológica de las modalidades que surgen a partir de la relación entre lo infinito y lo finito por medio de estatuas o representaciones figurativas. Nuestra hipótesis consiste en exponer la matriz ontológico-relacional del pensamiento bruniano (...) y la riqueza expresiva de las modalidades que se reflejan a partir del concepto de relación y su representación figurativa bajo la figura del Demogorgon. En efecto, consideramos que se trata de una clave de interpretación factible para comprender la complejidad de los vínculos entre trascendencia e inmanencia en el pensamiento filosófico de Bruno. Para ello, analizaremos en primer lugar los conceptos que componen la tríada Alma del Mundo, Espíritu e Intelecto Primero, tal como se exponen en Lampas triginta statuarum. Luego exponemos el entramado relacional de estos conceptos con el objetivo de enfatizar los aspectos fundamentales de la inmanencia en la obra de Bruno. Por último, abordamos la noción de relacióncomo categoría que permite unificar los distintos aspectos de la inmanencia en la cosmología bruniana a partir de la figura mitológica del Demogorgon. Este artigo tem o objetivo de propor em linhas gerais uma alternativa ao discurso antropológico-humanista do pensamento filosófico, que predominava em fins do século XIX, e que ainda hoje estende seus efeitos ao pensamento da filosofia sobre a educação e sobre o tema do sujeito e da constituição da subjetividade no processo educativo.

This paper elaborates on the link between different types and degrees of experience that can be gone through within a form of life or collectivity—the so-called levels of immersion—and the development of distinct types of tacit knowledge and expertise. The framework is then probed empirically and theoretically. In the first case, its ‘predictions’ are compared with the accounts of novices who have gone through different ‘learning opportunities’ during a pre-operational training programme for running a huge nickel industrial plant in Brazil. (...) These are also analysed vis-à-vis the experience of an expert who has designed and experienced the outcomes of two pre-operational training sessions in the nickel industry before developing and managing the one discussed here. Theoretically, the framework is used to pinpoint exactly what interactional experts who have developed their expertise through linguistic socialisation alone are able to do as well as to analyse the case of technical connoisseurs. The results indicate that the proposed framework is useful. It supports the design and improvement of training programmes for the development of tacit knowledge while at the same time bringing about a refined analysis of claims concerning the abilities of types of experts and expertise. The use of machine learning algorithms has become ubiquitous in hiring decisions. Recent studies have shown that many of these algorithms generate unlawful discriminatory effects in every step of the process. The training phase of the machine learning models used in these decisions has been identified as the main source of bias. For a long time, discrimination cases have been analyzed under the banner of disparate treatment and disparate impact, but these concepts have been shown to be ineffective in the (...) context of AI. This paper examines the possibility of studying algorithmic discrimination from the perspective of negligence law. Negligent selection and validation of datasets and classifiers is a salient cause of improper training in machine learning. It is a breach of an employer’s duty to protect others, a failure of its exercise of due care in the manner of choosing employees. Adopting negligence to algorithmic discrimination requires a reformulation of what is foreseeable and reasonable within the context of black box algorithms, and a shift in the burden of proof to the employer, who must present evidence of its efforts to avoid bias.
